RUGBYNOMAD LLC DBA RUGBYNOMAD TOURS – LIABILITY WAIVER AND RELEASE FORM
READ CAREFULLY: THIS IS A LEGALLY ENFORCEABLE WAIVER OF RIGHTS AND ASSUMPTION OF RISK
I acknowledge that I have voluntarily applied to participate in a trip/tour organized by RUGBYNOMAD LLC DBA RUGBYNOMAD TOURS, created and organized by Scott W Poindexter. I understand that travel—especially group experiences involving activities like coaching rugby, being around rugby being played, non-rugby adventure activities, international destinations, and shared accommodations—can have certain inherent risks.
I am voluntarily participating in this tour with the complete understanding that travel to foreign countries and/or remote areas can involve numerous risks and dangers, including but not limited to: illness, injury, or death resulting from natural forces, civil unrest, terrorism, road conditions, contact with wild or domestic animals, insect bites or stings, substandard infrastructure or transportation methods, high altitudes, limited medical resources, and/or negligence on the part of RUGBYNOMAD LLC DBA RUGBYNOMAD TOURS, Scott W Poindexter, their affiliates, contractors, trip leaders, volunteers, or other associated parties.
I further acknowledge that the joy, fun, partying and excitement of RUGBYNOMAD TOURS experiences stem partly from the unpredictable nature of travel, rugby events and environments, and the vulnerability of group adventure. These risks contribute to the unique value of the experience, and I accept them as part of my voluntary participation.
RELEASE OF LIABILITY
In consideration for being permitted to join any RUGBYNOMAD TOURS trips/tours, or activity organized by RUGBYNOMAD LLC DBA RUGBYNOMAD TOURS, and Scott W Poindexter, I, on behalf of myself, my heirs, successors, assigns, and personal representatives, hereby release and forever discharge the aforementioned entities and individuals from any and all claims, demands, or causes of action for injury, loss, damage, or death arising from my participation—whether arising from negligence or otherwise.
This waiver covers all trip-related events and optional activities, whether hosted by RUGBYNOMAD TOURS or third-party providers.
If any provision of this waiver is found unenforceable, the remainder will remain in full force and effect.
I understand and agree that the maximum liability of RUGBYNOMAD LLC DBA RUGBYNOMAD TOURS, or Scott W Poindexter for any reason shall not exceed the actual land cost I paid for the trip.
DISPUTES AND JURISDICTION
I waive any charge-back rights. If a dispute arises, I will follow the cancellation and refund procedures outlined in the trip’s official Terms & Conditions.
All applications and payments are subject to acceptance by RUGBYNOMAD LLC DBA RUGBYNOMAD TOURS. Upon acceptance, this waiver shall be deemed to have been entered into in Green Cove Springs, Florida, and governed by the laws of the State of Florida. I agree that any legal claims or disputes will be resolved exclusively in Green Cove Springs, Florida, USA.
KNOWING AND VOLUNTARY EXECUTION
I confirm I have read and understood this entire agreement—including the referenced Terms & Conditions. I understand this is a release of liability, and I sign it knowingly and voluntarily, with full awareness of its legal consequences.
